PRICING, LICENSING AND COPYRIGHT
Many
of our clients ask us how we determine and
establish our pricing and why we
License our photos? Photography, as with any
visual art, is Not a commodity to the
client we represent, but more so an
advertising/marketing tool that helps promote
our client product or business. We hope this
information will help in creating an
understanding of the art of photography, and how
important it is to your business to invest in
professional photography and be assured that
your product or business will be represented in
the best way possible.
When determining pricing, several things are
accounted for, such as:
-
Photographer's creative fee: (or otherwise
known as a "day rate"), which is billed per
hour, or per day, depending on the amount of
time, effort and creative circumstances of
the assignment.
-
Travel time & accommodations: to and from the
job (this would include gas mileage, hotel
accommodations if out of the photographers
normal area of business)
-
Equipment rentals: To get the right shot
for our client, we may require additional
equipment not customarily used on an
assignment. For instance, a photographer
may need to rent a cherry picker to get a
required shot, or the BEST shot, depending
on what is required and the environment for
the assignment. Others may need to rent a
helicopter if an aerial view is required,
extra props, extra cameras, specialized
lenses, or even an assistant if more than
one person is required for the assignment.
-
Post Processing: Photographers now work in
what is primarily a digital industry, and
what used to take place in the darkroom, now
takes several hours of work on the computer
with programs specifically created for
professional photographers by Adobe, Inc.
Generating the proper exposure and creating
a truly great image now not only requires
the photographer to be a great photographer,
but also an expert in digital enhancement
and graphic arts.
-
Media used for the delivery of the photos:
The “packaging”. Depending on what is being
delivered to the client, i.e. CDs, DVDs, FTP
transfers, etc., this is also taken into
consideration as part of the photographer’s
presentation to the client.
-
LICENSING the images: The licensing depends
on the circulation and type of media in
which a photo is to be published (i.e.
advertising/marketing materials, editorial,
website use, books, international use,
etc). For more information on licensing,

-
COPYRIGHT Registration: Like any creative
industry, in order to preserve and protect a
photographer’s work, images must be sent to
the US Library of Congress for copyright
registration. This ensures that images will
be used for their intended purposes and
provides additional protection to the client
as well, should someone misuse the images
they have licensed with the photographer.
For more information on copyright, please

Our company ONLY grants
NON-EXCLUSIVE RIGHTS. That allows our clients to
use the photos for their specific use and also
allows us to continue using the photos in our
portfolio and re-license them to someone else if
we are asked too and in compliance with the
original client's Terms & Conditions Agreement.
IF our clients STILL want to use the photos
after the licensed period ends, we can
re-license the photos again for a fee, usually
the same fee charged prior, unless their
circulation changed and the license fee will
need to be re-calculated.
